The owners of Harley Medical Group, the biggest UK provider of PIP breast implants, has financially restructured.

A new company owns Harley Medical group although they are still operating on the same premises with the same staff.

Critics say they think that was to avoid legal action being taken against the firm by PIP patients but has been denied by Harley Medical Group.

A spokesman said the cost of replacing implants severely constrained business and that it was not a deliberate act.

He said more people had ruptures than they had originally expected.

Harley Medical Group statement

Almost 14,000 women had PIP implants through Harley Medical Group and so far they have removed and replaced around 1,000.

A statement from a Harley Medical Group spokesman added: "We have removed free of charge faulty implants from those patients where there was a medical need.

"This was the right thing to do and is in line with recommendations from expert reviews but the impact on our business has meant that we would have been unable to continue without restructuring and bringing in new investment.

"The restructuring now allows us to continue to care for our patients who have medical issues arising from PIP implants and to continue our duty of care to the rest of our surgical and non-surgical patients, as normal."

John Farrow is a lawyer and represents 300 people who had PIP implants through Harley Medical Group. He says there are three possible options.

"To investigate what insurance they did have, to pursue a credit card claim if you paid for any of the procedure that way and finally trying to get the right to pursue the supplier of Harley Medical Group direct."

PIP implant patient tries to take legal action

Jodie Shepherd is 28 and had PIP implants. Although they hadn't ruptured she was trying to take legal action against the firm after she says she had to pay £2,000 to have her implants replaced by another company.

"Even if they had offered to do the surgery again with new implants I would have been happy with that," she said.

"I wasn't offered anything. No scan, no replacement, no money back."

The Health Minister, Lord Howe said: "I will be looking into this as a matter of urgency.

"It is extremely disappointing that the Harley Medical Group have chosen to do this.

"All medical practices have a duty of care towards their patients, which should include appropriate aftercare, and compensation if treatments go wrong."

Normally administrators take control of companies when they can no longer pay their bills and one of their main jobs is to keep the business running while looking for a new owner.

For existing patients, Harley Medical Group say nothing will change.

In a statement Harley Medical Group say "we believe that the action that has been taken remains the only action, in the prevailing circumstances, that could have been taken in the best interests of our PIP and other patients".
